 - We try hard to make product descriptions accurate, and pictures too, but we cannot guarantee their accuracy. Please contact us if you have a specific need you want to check with us first.

 - Our stock levels are not real-time, and so if you are in any doubt please do give us a call or drop us an email and we will get back to you with a more accurate stock level.

 - Sometimes our suppliers will tell us they have discontinued an item, but you might be the first to find out. We cannot guarantee all items will always be available.

 - We will not be responsible for compensating you for any losses resulting in our not being able to supply you with the goods. Instead, we will refund you right away or offer our nearest alternative which may cost more, and sometimes less.

 - We accept returns of all faulty goods.

 - For items you change your mind on, or made a mistake ordering, you must authorise the return with us and get them back to us within 14 days of the original delivery date. They must be untouched, unopened even, in a perfectly resalable condition. We decide if this is the case upon receipt of the return.

 - Although some items include delivery or say 'FREE' delivery, there is a cost to delivery PER cabinet that we cannot refund if you don't want the goods anymore.

 - There is a restocking fee for unwanted items.

 - Quite a few of our items are custom items, made to order, and so we cannot accept returns of unwanted custom items. The item's page will be clear if it is made to order.

 - If you cancel an order of a custom item, made to order, there will be cancellation and admin fees - so please be sure that you want the item first.

 - Delivery rates are strictly UK mainland up to Glasgow. A sample list of excluded postcodes is found in the Terms and Conditions below. Please check before ordering if your delivery address is above Glasgow.

INTRODUCTION to Terms and Conditions

The following terms and conditions apply to all transactions on Comms Rack (this Website) a trading name of GWT Media Ltd. Using this Website indicates your acceptance of these terms and conditions. Placing an order indicates your acceptance and the terms listed are subject to change at any time. Any changes will take effect on the date they are posted onto the site. Please read them carefully and print a copy for future reference. Because of the nature of the items we sell, please pay special attention to the ‘Returns and Refunds Enquiries’ section. Anything mentioned on our ‘Delivery’ page is also included as part of these terms.

General

These terms and conditions do not affect your statutory rights. To order goods using this website you must be at least 18 years of age and accept delivery within the UK. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Accuracy of Product Information and the Description of Goods

Product specifications, images and other information published on our Website have either been made accessible by suppliers, manufacturer's, publications, publicists, or been gathered from public-domain sources. The intention of Comms Rack is that all information on the Website should be as accurate and up to date as possible. Comms Rack cannot guarantee the reliability or the accuracy of the information contained within its pages. Actions taken by the user of the Website are the responsibility of the individual. Images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Stock levels are indicative only. If stock is showing low, please contact us first and we will carry out a real-time stock check. Always check the item description for any delivery date notifications.

Payment and Price

The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices or the imposition of any taxes or duties, or delivery surcharges for specified locations under ‘Delivery Charges’. Prices may be subject to change if the price published for the goods is wrong. In all cases we will inform you of the correct price and give you the opportunity to cancel the order.

Payment Methods

We accept (via PayPal only) all major Credit and Debit cards as forms of payment. You may also pay by BACS, cheque or postal order although we cannot dispatch the goods until payment has been cleared which can take up to 14 days from receipt of payment. Your order will only be processed once authorisation of your credit card has been properly received.

Availability of Goods

All products and services are subject to availability and may be withdrawn at any time. In the unlikely event we are unable to provide the item we will not charge you for these and we will refund any money already paid for them. We will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Delivery Charges added at Checkout

Irrespective of 'FREE Delivery' promotions or displayed delivery prices, our packing and delivery costs for all floor standing cabinets is up to £85 + VAT, wall mount cabinets is up to £40 + VAT, and all other items up to £10 + VAT to UK mainland. These prices are used when refunds and exchanges are calculated.

This excludes Northern Ireland (BT), Isle of Man (IM), Scottish Highlands and Orkney Isles (PA, ML, EH, FK, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE).

All prices on our Website are exclusive of delivery charges which will be added to the price of the products at our checkout. Delivery prices quoted are for most UK Mainland addresses. Northern Ireland (BT), Isle of Man (IM), Scottish Highlands and Orkney Isles (PA, ML, EH, FK, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE) will incur additional charges (email us for a quotation) and may also experience delivery delays. If you place an order to be delivered to any of these postcode areas, we will contact you with a delivery quote before processing the order. Additionally, AM and Saturday deliveries are optional and will also incur additional charges. These can be obtained upon application.

Requirements for Successful Delivery / Re-delivery Charges

The buyer must supply a valid telephone number and contact name at the Checkout, or PayPal Checkout (use special instructions) so as to avoid delay in receiving the item. We pass this on to the courier only.

The buyer must make sure someone is available to take delivery of the item. For smaller items, redelivery charge of £10.00 + VAT (item depending) may be payable if the customer has not made sure that someone is available to take delivery, or collection from the local depot will have to be arranged by the customer - this is at the courier’s discretion.

For pallet deliveries (some wall racks, larger racks, and all floor standing racks) the customer must make sure someone is available to take delivery and sign for the delivery before placing the order. A redelivery charge of up to £85.00 + VAT PER cabinet will have to be paid if incorrect details are given or someone cannot take delivery of the item.

ALL deliveries are made to street level only. We sometimes use Google street view to determine if you might need a parking dispensation from your local authority and we will advise you to do so. Any parking fines or tickets incurred will be passed on to the customer. Although rare, this must be stated.

With LMS Data products (EL, and ECO NetCab racks), to assist you with the above we will call ahead of arranging delivery. We will also make a follow up call to ensure we are doing all we can to make the delivery process as smooth as possible - and to avoid costly re-deliveries.

Delivery Times

Most items are delivered within 3 working days from the date of order, except those that are custom items, manufactured to order. We will endeavour to deliver goods within the times stated. On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.

Risk

As soon as we have delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.

Time Limitation for Notification of Claims

If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note and it will be your responsibility to inform us within 1 day from delivery.

It is your responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 7 days from delivery.

If we supplied you with a product other than ordered it is your responsibility to notify us of any incorrect goods supplied within 7 days from delivery. Comms Rack will not accept liability for goods lost in transit unless we are notified within 7 days from the courier’s expected delivery date.

If goods returned under this clause are found to be perfect and in full working order, these will be returned to you and an administration fee of 25% of the price of the goods along with the cost of carriage will be charged to your credit card account or you may not receive a full refund.

Product Guarantees - General

All products supplied are covered by the terms and conditions of Comms Rack for a period of 12 months. This guarantee specifically excludes faults caused by accident, neglect, and misuse. This does not affect your statutory rights.

Unwanted, non-custom items must be returned within 14 days of delivery at your own risk and cost. There will be a restocking fee of up to 25% and we cannot refund the original delivery costs. See ‘Returns and Refund Enquiries’ for full details.

Order Cancellation
Please note that all cancelled orders will incur a charge of 3% of the total order value in addition to a £15 admin fee. 'Cancelled orders' are those which have been cancelled before the goods have been manufactured and delivered, after which it becomes a 'Return' and must be processed on the terms below.

Returns and Refund Enquiries

We are unable to accept returns of custom items unless they are faulty. Cabinets that are made as special, custom items, include: WM, FS, VS, SR, ARW, ARM, WAR (WM wall racks, FS data racks, and VS server racks, SR premium racks, Acoustic, Wood effect acoustic, Dust free, Aircon) and other manufactured to order items at our discretion. NOTE: Although these items show as ‘in stock’, this is purely to enable you to buy them from the shop. These are not stock items and are custom items, manufactured to order. Each product’s individual product page contains information as to its product code and custom item 'stock' status, e.g. "5 working days, manufactured to order".

RETURNS:
Unwanted, non-custom items must be returned 'AS SOLD' in the original packaging with all components and accessories.

Goods must be returned to our returns department within 14 days from the date of delivery and only after the return has been authorised by us. We are unable to accept returns of unwanted and non-faulty items after 14 days from the date of delivery.

Goods eligible for return must be complete, unused, and in 'AS NEW' condition (e.g. if you have opened the box to examine the product it must have been done so without damaging the box and packaging or damaging the product in any way) and must be repackaged exactly as received.

Any 'FREE GIFTS' with the products must also be returned.

Unwanted items that we authorise for return will be refunded, less the original delivery cost, less a 25% restocking fee.

Then, if we have authorised your return request, please return items under the above policy to the address we will provide you with. 

NOTE: You must organise the return the eligible unwanted, non-faulty items at your expense and risk. Returns cannot be accepted without prior authorisation and a returns authorisation number. The returns authorisation is valid for up to 14 days from the date of delivery. Goods sent back without prior returns authorisation will be returned back to you and the cost of delivery charged to your account even if you refuse delivery.

REFUNDS:
Full refund of the cost of the goods only is wholly conditional upon the above conditions being met and the refund being authorised only after a full inspection of the goods by our returns department to check for completeness and correct product return.

For goods received back complete ‘AS NEW’ and unused and in the original box and packaging including all accessories and in re-sellable condition: You will be refunded the full invoice price less 25% re-stocking fee and less delivery cost.

Goods received back complete ‘AS NEW’ and unused and in original box and packaging but with accessories missing: You will be refunded the full invoice price less 25% restocking fee, less delivery cost, and less price of accessories missing.

Goods received back not in a re-sellable condition: We are unable to accept these back under the above terms and the goods will be returned back to you and the cost of delivery charged to your account.

Other

You will own the goods once we have received your payment in full. We will issue you with an electronic invoice by email on request. Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions. These terms and conditions are subject to change at any time without prior notice to you.
